In August 2018, an amendment to the Austrian Federal Contracts Act entered into force, meaning innovations for tendering consultant engineering offices (if one is aware of them and offers services for public clients, etc.).

A new point is represented by the so-called conflicts of interest. On the tendering side, this means that one should not participate in the tender if such a case is present.

A conflict of interest is present if the awarding party loses its impartiality due to influence or contact. Clearly, any resulting advantages of the awarding party in economic, financial or similar matters also represent a conflict of interest. Even personal interests are included, i.e. family, friendly and political relationships or similar are also motives to pronounce such a case.

The corresponding compliance rules are recommended for the tendering parties, as they may otherwise be excluded from the procedure.
